These terms govern your use of RE Ace (“the app”), published by Eks (“we”, “us”). By installing or using the app you agree to them. If you do not agree, please do not use the app. Contact: Ekspeace@gmail.com.

1. What RE Ace is

RE Ace is an independent study aid for candidates preparing for the South African FSCA regulatory examinations RE5 (representatives) and RE1 (key individuals). It provides practice questions, mock examinations, flashcards, drills, summaries and a reference of statutory periods and thresholds.

2. No affiliation

RE Ace is not affiliated with, endorsed by, accredited by or connected to the Financial Sector Conduct Authority (FSCA), Moonstone Business School of Excellence, the Insurance Sector Education and Training Authority, or any examination body, regulator or accredited training provider. References to the FAIS Act, Board Notices, Conduct Standards and other legislation are made for study purposes only. All trade marks belong to their respective owners.

3. Not legal or compliance advice

The content of the app is educational material. It is not legal advice, not compliance advice, and not a substitute for the legislation itself. Nothing in the app creates a professional or advisory relationship between you and us.

Do not rely on the app when making a regulatory, compliance or business decision. Always confirm the current text of the Financial Advisory and Intermediary Services Act, the General Code of Conduct, the applicable Board Notices, the Financial Intelligence Centre Act and any other instrument directly from the official source, and take advice from a suitably qualified compliance professional.

4. Accuracy of content

Regulatory material changes. Periods, thresholds, monetary limits and even whole sections are amended, replaced and repealed, and an app cannot update itself the moment that happens. We prepare the content carefully and correct errors when we find them, but we do not warrant that the content is accurate, current or complete, and you use it on that basis.

If you believe an answer, explanation or citation in the app is wrong, please tell us at Ekspeace@gmail.com. Corrections are the single most useful thing a user can send us.

5. No guarantee of a pass

The app is a preparation tool. Sitting mock papers in it does not guarantee that you will pass the RE5 or RE1 examination, and no score, percentage or “readiness” figure shown in the app is a prediction of your result or a representation that you are ready to sit the real examination. Examination fees, results and re-sits are entirely a matter between you and the examination body.

6. Adverts and access

RE Ace is free. It is funded by advertising, and a full timed mock examination is unlocked by watching short rewarded video adverts. That means a mock examination requires an internet connection; the rest of the app works offline.

You agree not to interfere with, block, or attempt to circumvent the adverts, and not to use tools that generate artificial advert impressions or clicks. We may withdraw, change or interrupt advert-funded features at any time, including if an advert network is unavailable.

We may introduce a paid, advert-free version in a future release. If we do, these terms will be updated before it goes live, and nothing you already have will be taken away and sold back to you.

7. Acceptable use

You agree not to:

8. Intellectual property

The app, its design, and its original questions, explanations, flashcards and summaries are owned by us and protected by copyright. Quoted or paraphrased legislation remains the property of its authors and publishers. You get a personal, non-transferable, revocable licence to use the app for your own examination preparation, and nothing more.

9. Your data

Your progress is stored on your device only, and uninstalling the app deletes it. We do not hold a copy and cannot restore it. See the Privacy Policy for the detail.

10. Availability and changes

We may change, suspend or discontinue the app or any of its features at any time, and we may update these terms. Continued use after a change means you accept the updated terms. The “Last updated” date above will always tell you which version you are reading.

11. Limitation of liability

To the fullest extent permitted by law, the app is provided “as is” and without warranties of any kind, express or implied.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, opportunity, business, examination fee, employment, appointment, licence or authorisation, arising from your use of — or reliance on — the app or its content.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including your rights under the Consumer Protection Act 68 of 2008 where it applies to you.

12. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
